Personal injury

You may have a personal injury case if you or a loved one has been injured (or a loved one died) because of the negligence of another. Negligence is when a person who owes you a duty of care acts or fails to act in a way that a reasonable person would in a situation and causes harm.  Personal injury cases include claims from car accidents, bus accidents, motorcycle or bicycle accidents, dog attacks and unsafe property conditions.

We understand that suffering an unexpected injury can be traumatic and disruptive to your life in many ways.  You may experience physical injury, mental suffering and economic losses (such as medical bills or lost wages) due to a debilitating injury.  In many cases, you will need to deal insurance company claims representatives and attorneys, which may be stressful and time-consuming.  You may find yourself trying to understand the insurance and legal processes without knowing what you may be entitled to.  And, the insurance companies are not looking out for you; they are trying to minimize their own expenses.  That is why it is in your best interest to hire an attorney whose job it is to fight for the maximum compensation you deserve under the law for the damages you have suffered.
At West L.A. Law, P.C., we will handle your personal injury case completely. We will sit down and discuss the facts of the case with you to fully understand the issues and will investigate further to make sure we have all the necessary information to adequately assess your case.  As your attorney, we will obtain all the required documentation, obtain your medical records, submit insurance claims, obtain the necessary evidence to prove your claim, and negotiate with the insurance company and represent you in court, if necessary.

Car Accidents
Unfortunately, car accidents occur every day on city streets and freeways due to many reasons, including driver inattention, drunk driving or violation of traffic rules.  These accidents result in numerous personal injury claims based on negligence.  Negligence is when a person who owes you a duty of care acts or fails to act in a way that a reasonable person would in the same situation and causes harm.  As the victim of another person’s negligence, you have the right to sue the person that caused your injuries and to be compensated for them. To prove your case, you will need to show that another person had a duty to you, that he/she violated that duty, that the violation caused your injuries, and that you suffered damages, such as pain, suffering, medical expenses, and lost wages. In many cases, you will need to prove your claim to an insurance company and try to negotiate a settlement.  If a settlement cannot be reached, you can file your case in court.

It is understandable that you may not be in a frame of mind or physical state to handle your legal claims if you have been injured in a car accident.  West L.A. Law, P.C. can represent you in collecting all the documentation for your claim and represent your interests in dealing with the insurance company or individual who is responsible for compensating you for your losses.  We will assess your case, investigate the facts, talk to witnesses, determine the extent of your injuries, document your medical expenses and lost wages, discuss your case with medical or other experts, negotiate a settlement with the insurance company, or, if needed, file your case in court.  And, we take these cases on a contingency basis, which means, you do not have to pay us unless we are able to win your case, either by settling with the responsible party or obtaining a court order for monetary damages.

Bicycle Accidents

Because of the great weather in Los Angeles, the frustrating traffic, and the environmental benefits, more and more people are choosing to ride bicycles.  There are more bike lanes every day and drivers and bicyclists must learn how to share the rode.  Unfortunately, this is easier said than done at times.  Bicyclists are often more vulnerable to serious injuries if they are hit by a car since they don’t have protection like those inside a car.  They can suffer injuries such as, bruises, fractures, loss of limbs, head and brain injuries and even death.

Pedestrian injuries caused by motor vehicles can be some of the most devastating, resulting in serious bodily injury or death in many cases, given that they have no protection from the impact.  These accidents are most often caused by the negligence of the motor vehicle driver, who may be speeding, using a cell phone, driving drunk, or disobeying traffic signs and signals.

Premises Liability

A property owner may be responsible for injuries caused by a dangerous condition on his/her property under the legal claim of Premises Liability.  Property owners have a duty to make their property reasonably safe for those who visit or reside on it.  If they are aware of a dangerous condition, such as the lack of proper lighting in stairwells, wet surfaces, or improperly constructed surfaces that present a tripping or falling hazard, they must provide warnings of the condition and remedy the problem.  A failure to do so may cause an injury for which the owner can be held legally accountable for their negligence.  Premises liability can apply to any public or private property, including homes, apartment buildings, office buildings, stores, or restaurants.
